Ele pleiteava o afastamento da justa causa, assim como a rescis\u00e3o indireta (quando h\u00e1 falta grave do empregador, levando \u00e0 invers\u00e3o da demiss\u00e3o por justa causa). <br><br>Ao analisar o caso, o juiz do trabalho F\u00e1bio Augusto Branda (2\u00aa Vara de Guaruj\u00e1-SP) verificou que a jornada do ex-empregado era das 7h \u00e0s 13h. Por\u00e9m, por iniciativa unilateral do empregador, o hor\u00e1rio foi alterado para o per\u00edodo das 15h \u00e0s 23h. Ocorre que o trabalhador det\u00e9m a guarda de dois filhos menores, um deles com s\u00edndrome de Down e que necessita de cuidados especiais, principalmente no in\u00edcio da noite. <br><br>A senten\u00e7a aponta o fato de que n\u00e3o havia cl\u00e1usula contratual permitindo a altera\u00e7\u00e3o unilateral do contrato quanto ao hor\u00e1rio de trabalho. Na decis\u00e3o, o juiz cita trechos da Constitui\u00e7\u00e3o Federal (CF), da Consolida\u00e7\u00e3o das Leis do Trabalho (CLT) e do Estatuto da Pessoa com Defici\u00eancia. Aplicou, ainda, a Conven\u00e7\u00e3o da ONU sobre os Direitos das Pessoas com Defici\u00eancia, \u00e0 qual o Brasil aderiu em 2009, destacando o \u201cart. 7\u00ba (&#8230;) 2. Em todas as a\u00e7\u00f5es relativas \u00e0s crian\u00e7as com defici\u00eancia, o superior interesse da crian\u00e7a receber\u00e1 considera\u00e7\u00e3o primordial.\u201d <br><br>Segundo o magistrado, &#8220;o autor n\u00e3o abandonou o emprego, n\u00e3o tinha \u00e2nimo do abandono, mas recusa leg\u00edtima em ter alterado uma cl\u00e1usula contratual que importaria risco \u00e0 integridade, educa\u00e7\u00e3o e conv\u00edvio familiar da filha com defici\u00eancia&#8221;. Assim, afastou a justa causa, reconheceu a rescis\u00e3o indireta e deferiu as verbas rescis\u00f3rias relativas a essa forma de extin\u00e7\u00e3o contratual. <br><br>Cabe recurso. <br><br>(Processo
