Ao rejeitar o exame de recurso da empresa contra a ordem de reintegra\u00e7\u00e3o no emprego, o colegiado reafirmou o entendimento da\u00a0<a href=\"https:\/\/www3.tst.jus.br\/jurisprudencia\/Sumulas_com_indice\/Sumulas_Ind_401_450.html\" target=\"_blank\" rel=\"noreferrer noopener\">S\u00famula 443<\/a>\u00a0do TST, que presume discriminat\u00f3ria a dispensa de pessoa com doen\u00e7a grave que cause estigma ou preconceito. <br><br><strong>Sob controle <\/strong><br><br>O empregado disse, na reclama\u00e7\u00e3o trabalhista, que estivera afastado por v\u00e1rios per\u00edodos durante os 11 anos de Equatorial, em raz\u00e3o da doen\u00e7a, sobretudo em 2017, quando teve de se afastar pelo INSS. Ao retornar ao trabalho \u2013 e com a doen\u00e7a sob controle \u2013, ele foi dispensado sem justa causa, o que o levou ao agravamento do problema, \u201cprovocando um verdadeiro desespero\u201d. A situa\u00e7\u00e3o o impediu de buscar novo emprego. <br><br><strong>Doen\u00e7a grave<\/strong><br><br>O ju\u00edzo da Vara do Trabalho de Floriano (PI) declarou a nulidade da rescis\u00e3o do contrato e deferiu a reintegra\u00e7\u00e3o do empregado. A senten\u00e7a foi mantida pelo Tribunal Regional do Trabalho da 22\u00aa Regi\u00e3o (PI), para o qual\u00a0houve abuso de direito do empregador, com viola\u00e7\u00e3o da dignidade humana, por se tratar de doen\u00e7a grave e sem cura. \u201cA empresa demitiu o empregado ap\u00f3s ele retornar de sua licen\u00e7a m\u00e9dica, mesmo necessitando do seu servi\u00e7o, substituindo-o por outro\u201d, registrou o TRT.\u00a0 <br><br><strong>Fatores financeiros <\/strong><br><br>A empresa recorreu ao TST alegando que a dispensa ocorrera ap\u00f3s a privatiza\u00e7\u00e3o, quando foram demitidas outras 17 pessoas, com objetivo de conten\u00e7\u00e3o de gastos e reestrutura\u00e7\u00e3o. Essa circunst\u00e2ncia afastaria a aplica\u00e7\u00e3o da S\u00famula 443 do TST, pois demonstraria que a dispensa decorrera de fatores financeiros. <br><br><strong>Estigma e preconceito <\/strong><br><br>O relator, ministro Lelio Bentes Corr\u00eaa, disse que n\u00e3o h\u00e1 d\u00favida, no TST, quanto \u00e0 gravidade e \u00e0 natureza estigmatizante da esquizofrenia. Ele lembrou que, antes mesmo da edi\u00e7\u00e3o da S\u00famula 443 e de legisla\u00e7\u00e3o que assegurasse a garantia provis\u00f3ria no emprego da pessoa com doen\u00e7a grave, o Tribunal reconhecia o direito \u00e0 reintegra\u00e7\u00e3o quando n\u00e3o havia motiva\u00e7\u00e3o plaus\u00edvel para a dispensa. \u201cS\u00e3o garantias constitucionais relativas ao direito \u00e0 vida, ao trabalho e \u00e0 dignidade da pessoa humana\u201d, ressaltou. <br><br>Segundo ele, em se tratando de esquizofrenia, h\u00e1 presun\u00e7\u00e3o relativa de que a dispensa \u00e9 discriminat\u00f3ria, a menos que seja demonstrada motiva\u00e7\u00e3o l\u00edcita e plaus\u00edvel do empregador para romper o contrato. No caso, por\u00e9m, n\u00e3o houve prova suficiente nesse sentido. <br><br>A decis\u00e3o foi un\u00e2nime. <br><br>Processo:\u00a0<a
