O colegiado constatou que a empresa havia encerrado as suas atividades produtivas na base territorial do sindicato do qual o empregado era dirigente, o que afasta o direito \u00e0 estabilidade.&nbsp; <br><br><strong>Garantia de emprego <br><\/strong><br>Na a\u00e7\u00e3o, o trabalhador disse que havia trabalhado na Arcelormittal como carbonizador (extra\u00e7\u00e3o de carv\u00e3o) de outubro de 1986 a julho de 2017. Em janeiro do ano da dispensa, foi eleito vice-presidente do Sindicato nas Ind\u00fastrias da Extra\u00e7\u00e3o da Madeira e da Lenha de Dion\u00edsio, com mandato at\u00e9 2020. Para ele, sua dispensa teria sido ilegal, pois teria direito \u00e0 estabilidade provis\u00f3ria at\u00e9 um ano ap\u00f3s o fim do mandato. <br><br><strong>Encerramento <\/strong><br><br>A Arcelormittal, por sua vez, justificou que, em abril de 2017, havia encerrado suas atividades em Dion\u00edsio. Como a extra\u00e7\u00e3o de carv\u00e3o vegetal,&nbsp;sua atividade preponderante, n\u00e3o ocorria mais no local, &nbsp;n\u00e3o caberia a manuten\u00e7\u00e3o da estabilidade do trabalhador.&nbsp; <br><br><strong>Validade da dispensa<\/strong> <br><br>O ju\u00edzo da 1\u00aa Vara do Trabalho de Jo\u00e3o Monlevade (MG) negou os pedidos de nulidade da dispensa, de reintegra\u00e7\u00e3o no emprego e de recebimento dos sal\u00e1rios correspondentes. O Tribunal Regional do Trabalho da 3\u00aa Regi\u00e3o (MG) manteve a decis\u00e3o, por avaliar que, com o encerramento da atividade da empresa, n\u00e3o subsiste a estabilidade provis\u00f3ria. <br><br><strong>Atividades mantidas <br><\/strong><br>Ao julgar recurso de revista, a Terceira Turma do TST considerou nula a rescis\u00e3o contratual, baseada no fato de que 55 empregados operacionais, 12 na administra\u00e7\u00e3o e 13 vigias terceirizados ainda trabalhavam para a empresa. Para a Turma, isso significa que n\u00e3o houve o encerramento total das atividades. <br><br><strong>Sem estabilidade <br><\/strong><br>O ministro Renato de Lacerda Paiva, relator dos embargos da Arcelormittal \u00e0 SDI-1, observou que, segundo as provas produzidas no processo, a empresa n\u00e3o tinha mais faturamento em raz\u00e3o do t\u00e9rmino da produ\u00e7\u00e3o de carv\u00e3o desde abril de 2017. Foram mantidos apenas alguns empregados para a manuten\u00e7\u00e3o florestal e a prote\u00e7\u00e3o patrimonial.&nbsp; <br><br>De acordo com o relator, contudo, a exist\u00eancia de um quadro reduzido de empregados n\u00e3o \u00e9 suficiente para justificar a garantia provis\u00f3ria de emprego pretendida. O encerramento da atividade preponderante da empresa na mesma base territorial do sindicato \u00e9 suficiente para que o trabalhador perca o direito \u00e0 estabilidade no emprego. <br><br>\u201cUma vez desativada a extra\u00e7\u00e3o de carv\u00e3o, cessa a garantia de emprego, pois os interesses defendidos pelo dirigente sindical deixaram de existir\u201d, concluiu.<br><br>A decis\u00e3o foi
