Segundo o colegiado,&nbsp; n\u00e3o h\u00e1 previs\u00e3o legal para a concess\u00e3o dessas parcelas quando o fim do contrato de emprego ocorre por justo motivo.&nbsp;<br><br><strong>Hist\u00f3rico de indisciplina<\/strong><br><br>Na&nbsp;<a href=\"https:\/\/www.guiatrabalhista.com.br\/tematicas\/processo_trabalho.htm\" target=\"_blank\" rel=\"noopener\" title=\"\">reclama\u00e7\u00e3o trabalhista<\/a>, a empregada pretendia reverter a justa causa com o argumento de que o motivo seria um suposto \u201chist\u00f3rico de indisciplina\u201d que n\u00e3o corresponde \u00e0 realidade dos fatos.&nbsp;&nbsp;<br><br>A empresa, em sua defesa, disse que ela fora demitida por ter praticado diversos atos de indisciplina, como faltas injustificadas, deixar de realizar o monitoramento, deixar o trabalho sem comunicar o superior hier\u00e1rquico e usar Facebook durante o trabalho. Segundo a empresa, em aproximadamente sete meses de servi\u00e7o ela j\u00e1 havia recebido sete&nbsp;<a href=\"https:\/\/www.guiatrabalhista.com.br\/guia\/advertencia_suspensao.htm\" target=\"_blank\" rel=\"noopener\" title=\"\">advert\u00eancias<\/a>&nbsp;e voltara a faltar injustificadamente dois dias no m\u00eas da dispensa.<br><br><strong>Direito fundamental<\/strong><br><br>A ju\u00edza da Vara do Trabalho de Esteio reconheceu que a empregada cometera falta grave ao agir com des\u00eddia (neglig\u00eancia ou desinteresse), considerando as reiteradas faltas injustificadas ao servi\u00e7o. Contudo, condenou a empresa a pagar diferen\u00e7as salariais, inclusive f\u00e9rias e&nbsp;<a href=\"https:\/\/www.guiatrabalhista.com.br\/guia\/13_1parcela.htm\" target=\"_blank\" rel=\"noopener\" title=\"\">13\u00ba Sal\u00e1rio<\/a>&nbsp;proporcionais.<br><br>O Tribunal Regional do Trabalho da 4\u00aa Regi\u00e3o (RS) manteve a senten\u00e7a, com fundamento no artigo 7\u00ba, inciso, VIII, da Constitui\u00e7\u00e3o Federal, que confere ao&nbsp;<a href=\"https:\/\/www.guiatrabalhista.com.br\/guia\/13_1parcela.htm\" target=\"_blank\" rel=\"noopener\" title=\"\">13\u00ba Sal\u00e1rio<\/a>&nbsp;status de direito fundamental, e na Conven\u00e7\u00e3o n\u00ba 132 da Organiza\u00e7\u00e3o Internacional do Trabalho, ratificada pelo Brasil em 1998, que trata do direito \u00e0s f\u00e9rias anuais remuneradas.&nbsp;&nbsp;<br><br><strong>Direito incompat\u00edvel com justa causa<\/strong><br><br>O ministro Agra Belmonte, relator do recurso de revista da empresa, observou que a S\u00famula 171 do TST estabelece, expressamente, que as&nbsp;<a href=\"https:\/\/www.guiatrabalhista.com.br\/guia\/ferias.htm\" target=\"_blank\" rel=\"noopener\" title=\"\">f\u00e9rias proporcionais<\/a>&nbsp;n\u00e3o s\u00e3o devidas nas situa\u00e7\u00f5es em que h\u00e1&nbsp;<a href=\"https:\/\/www.guiatrabalhista.com.br\/guia\/justa_causa_empregado.htm\" target=\"_blank\" rel=\"noopener\" title=\"\">dispensa por justa causa<\/a>. Tamb\u00e9m lembrou que o artigo 3\u00ba da Lei 4.090\/1962, que criou o&nbsp;<a href=\"https:\/\/www.guiatrabalhista.com.br\/guia\/13_1parcela.htm\" target=\"_blank\" rel=\"noopener\" title=\"\">13\u00ba Sal\u00e1rio<\/a>, restringe o pagamento da parcela aos trabalhadores dispensados sem motivo justificado.&nbsp;<br><br>A decis\u00e3o foi un\u00e2nime.&nbsp;<br><br>Processo:
