A decis\u00e3o restabeleceu senten\u00e7a que condenou empresa a pagar diferen\u00e7as salariais com base no piso estadual.<br>\u00a0<br>A controv\u00e9rsia surgiu ap\u00f3s o sindicato dos trabalhadores recusar-se a assinar conven\u00e7\u00f5es coletivas devido \u00e0 alega\u00e7\u00e3o de que as propostas apresentadas pelas entidades patronais eram desfavor\u00e1veis aos trabalhadores e inferiores ao sal\u00e1rio-m\u00ednimo estadual vigente.<br>\u00a0<br>Na aus\u00eancia de acordo, a federa\u00e7\u00e3o patronal assumiu as negocia\u00e7\u00f5es e firmou conven\u00e7\u00f5es que n\u00e3o foram reconhecidas pelo sindicato dos trabalhadores.<br>\u00a0<br>Em primeira inst\u00e2ncia, a empresa foi condenada a pagar as diferen\u00e7as salariais com base no sal\u00e1rio-m\u00ednimo estadual. No entanto, o TRT-12 reformou a senten\u00e7a, entendendo que as conven\u00e7\u00f5es firmadas pela federa\u00e7\u00e3o patronal seriam aplic\u00e1veis \u00e0 categoria. O sindicato recorreu ao TST.<br>\u00a0<br>O relator do caso, ministro Jos\u00e9 Roberto Freire Pimenta, destacou que a recusa do sindicato dos trabalhadores em assinar as conven\u00e7\u00f5es coletivas n\u00e3o foi injustificada, mas uma forma de proteger os interesses da categoria. Segundo a decis\u00e3o, &#8220;a recusa sindical deve ser analisada com base na razoabilidade e legitimidade dos motivos, especialmente quando as propostas patronais n\u00e3o garantem condi\u00e7\u00f5es m\u00ednimas previstas em lei&#8221;.<br>\u00a0<br>O relator tamb\u00e9m considerou que a representa\u00e7\u00e3o da federa\u00e7\u00e3o patronal n\u00e3o substitui a negocia\u00e7\u00e3o direta entre sindicato laboral e empregadores, conforme disposto no artigo 611, \u00a7 2\u00ba, da CLT.<br>\u00a0<br>Assim, decidiu-se pela aplica\u00e7\u00e3o do sal\u00e1rio-m\u00ednimo estadual, determinado por legisla\u00e7\u00e3o complementar, como par\u00e2metro para os per\u00edodos em que n\u00e3o houve acordo coletivo.<br>\u00a0<br>Com a decis\u00e3o, a 3\u00aa turma do TST restabeleceu integralmente a senten\u00e7a de primeiro grau, condenando a empresa ao pagamento das diferen\u00e7as salariais apuradas em liquida\u00e7\u00e3o de
